GDPR requires consent to be opt-in, which it defines as "freely given, specific, informed and unambiguous" given by a "clear affirmative action". I'm in the U.S. and I'm having issues prechecking a checkbox with JS and jQuery. I've already visited this forum and tried the solutions listed here: Do you have a solution for v7.1? Link to comment

Folks should not have to proactively take action to get out of something they didn't want to get into. Hence the reason laws were made to prohibit the practice in some locations. I don't think the US has national legislation on the issue yet. I think nationally the US is attempting to persuade folks with guidelines (ha, like that will work).
